Preliminary information

These Terms and Conditions specify the general conditions for the sale and redemption of vouchers, available for training and consulting services provided by Valkir Academy Sp. z o.o.

§ 2
Definitions

Training Center – Training and consulting company Valkir Academy Sp. z o.o. with headquarters in Warsaw, registered at aleja Waszyngtona 146, 04-076 Warsaw, signed into the National Court Register by the District Court for the Capital City of Warsaw in Warsaw, XIV Economic Department of the National Court Register under number 0000469954, VAT ID PL5213651824, share capital in the amount of PLN 10 000, represented by the Chairman of the Board – Daniel Piotr Skowroński.

Contact details, including email address and phone number, are available on the Training Center’s website in the contact section.

Customer – Both individual and company/institution purchasing the voucher and willing to use services such as training or consultancy.

Participant – Service recipient, a person using the voucher to attend either training or consulting services, who has self-registered as an individual or was delegated on behalf of a company/institution.

Voucher – Document in a form of a purchase confirmation, issued by the Training Center, enabling participation in training or consultancy services listed on the website https://valkir.pl/en/.

Consumer – Customer who is an individual concluding an agreement for a delivery of services with the Training Center, not related directly to the business or professional activity of that person.

GDPR – Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).

Force majeure – An extraordinary, external event, impossible to foresee and inevitable which may obstruct the service or make it completely undeliverable.

Service – Training service, consulting service or other service provided by the Training Center for the Customer/Participant.

Agreement – Agreement for the sale of the Voucher to the Customer/Participant.

§ 3
General conditions

  1. Customer confirms being acquainted with these Terms and Conditions, accepted and obliged to comply with them in full.

  2. The Customer may purchase the Voucher via the form available on the Training Center’s website, directly at the Training Center’s headquarters or via a form sent by an email or traditional mail.

  3. The Voucher can only be redeemed for Services offered by the Training Center.

  4. It is allowed to buy a Voucher of any value, however not lower than the lowest offer for training or consulting service participation (valid on the day of purchasing the Voucher), in accordance with the price list on https://valkir.pl/en/.

  5. Terms of payment for the Voucher: Payment for the Voucher is made on the basis of a pro-forma invoice sent to an email address provided in the form or order by the date indicated on the invoice. After paying the pro-forma invoice, the Customer receives a VAT invoice and the Voucher itself via email to the email address provided in the form or order.

  6. Vouchers can be added up.

  7. The Voucher is not refundable, except for the provisions of paragraph 6, and cannot be exchanged for cash or other coupons with cash value.

  8. In case the price for the Service exceeds the value of the Voucher, the Customer/Participant wishing to use the given Service using the Voucher is obliged to cover the price difference. The Customer is obliged to pay an additional payment at least 5 business days before the beginning of the Service delivery, on the basis of the pro-forma sent by the Training Center. Lack of payment prevents participation in the selected Service.

  9. In case the entire amount for which the Voucher has been issued is not spent, the Customer/Participant is not entitled to a refund of the remaining amount.

§ 4
Voucher validity

  1. The voucher is valid for 12 months from the activation date stated on the Voucher.

  2. Voucher expiration date cannot be extended.

§ 5
Voucher redemption

  1. For service provision shall apply general Terms and Conditions available on: https://valkir.pl/en/terms/ with the exception of:
    • paragraph 4 – Payment terms,
    • paragraph 9 – Subsidized Services.

  2. In case of vouchers for training services, The Customer or the Participant directly is obliged to book a seat at a training at least 14 days in advance, by sending a message titled “Voucher redemption” to contact@valkir.net, including:
    • name and date of the training,
    • Participant’s contact details: name, surname, email address, mobile number.

    The guarantee that the seat was reserved is met only after receiving a return email with booking confirmation sent by the Training Center.

  3. In case of vouchers for consulting services, their redemption requires contact with the Training Center at least one month in advance via contact details available on: https://valkir.pl/en/contact-details/. Service delivery date will be agreed between the Customer and the Training Center, depending on the availability of consultants.

  4. The Training Center has the right to refuse voucher redemption in the following cases:
    • The Customer/ Participant has declared a willingness to redeem the voucher after its expiration date. In this case, the service won’t be provided and the funds paid will not be refunded.
    • The Customer / Participant declared their willingness to redeem the voucher in accordance with the Terms and Conditions, but there are no available seats for training in the selected period or available consultants who could provide consultancy services. In this case the Training Center will offer the service at a different date.

  5. Open training dates are available on: https://valkir.pl/en/.

§ 6
Withdrawal from the Agreement by the Consumer

  1. The Consumer who has concluded a distance or off-premises Agreement within the meaning of the provisions of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2020, item 287) has the right to withdraw from the Agreement within 14 days from its conclusion without giving a reason and without incurring costs, subject to clause 2 and 3 of this paragraph.

  2. The Consumer concluding the Voucher sale Agreement less than 14 days before the training/delivery of the Service agrees to start the provision of the Service before the expiry of the 14-day period referred to in clause 1. In such a case, the right to withdraw from the Agreement shall not apply from the moment the Service delivery begins.

  3. After expressly requesting the Service to be performed before the deadline for withdrawing from this type of Agreement, whenever the Consumer exercises the right to withdraw from the Agreement concluded remotely or off-premises, the Consumer is then obliged to pay for the Service fulfilled until the withdrawal from such an Agreement. The amount of the payment is calculated in proportion to the scope of the Service delivered, taking into account the fees agreed in the Agreement resulting from the provisions of Terms and Conditions paragraph 6 available on the website: https://valkir.pl/en/terms/.

  4. The 14-day period referred to in clause 1 above begins from the date of the Agreement conclusion.

  5. To meet the above deadline, it is enough to send a declaration of withdrawal from the Agreement to the Training Center via email to the email address available on the website. The Training Center will immediately confirm to the Consumer when the declaration of withdrawal from the Agreement will be received.

§ 7
Complaints

All complaints related to the delivery of Services with the use of redeemed Vouchers will be considered by the Training Center in accordance with the complaint process defined in the Terms and Conditions available on the website: https://valkir.pl/en/terms/.

§ 8
Final resolutions

  1. The Training Center reserves the right to amend the Voucher Terms and Conditions provided that it does not violate already acquired rights of the Customers/Participants.

  2. Any changes to the content of the Voucher Terms and Conditions will be updated on a regular basis and shared on the website https://valkir.pl/en/.

  3. Applicable provisions of Polish law shall apply to matters not regulated in these Voucher Terms and Conditions.

  4. Any disputes arising between the Customer/Participant who is not a Consumer and the Training Center resulting from the Agreement and these Terms and Conditions shall be resolved by amicable means and in the event of lack of resolution, the court having jurisdiction is the court relevant to the Training Center headquarters.

  5. Any disputes arising between the Customer/Participant who is a Consumer and the Training Center resulting from the Agreement and these Terms and Conditions may be resolved in an out-of-court manner of complaints processing and pursuing claims through the Permanent Consumer Arbitration Court at the Provincial Inspector of Trade Inspection in Warsaw. Information on how to access the procedures in force in this court can be found at: www.uokik.gov.pl.

  6. These Voucher Terms and Conditions shall apply from January 1st, 2021.
